4.2 Owner’s Use of Lot. An Owner’s use of his or her Lot shall be limited to residential purposes, but nothing herein shall be deemed to prevent a Owner from leasing his or her residence to a single family for the purpose of a residence, subject to these covenants and restrictions. All Owners leasing or renting their Lots or Homes shall be required to incorporate the following provision in their lease or rental agreements, substantially in the following form: The Lease Premises are a part of Subdivision. All persons occupying property in The Preserve At Lake Washington are required to observe the 19 Covenants and Restrictions of The Preserve At Lake Washington Homeowners Association, Inc. Copies of all Covenants and Restrictions are to be obtained from the Landlord. In addition, all Owners leasing their Lots or Homes are required to provide the Association with a copy of the lease or the names and addresses of the Landlord and the Tenant that are contained in the lease or rental agreement.
Don't forget the 2010 HOA dues are due on January 1st. Please pay on time to avoid a late fee or lien and court costs on your property. Thank you. We also need to keep a certain amount in reserve for emergencies e.g. hurricanes, tropical storms (Faye, which did damage to one of our retention ponds),fences repaired and other certain problems that come our way.
No dwelling, building or structure of any kind shall be constructed, erected, or altered on any Lot or in any part of the Subdivision, nor shall any exterior additions, changes or alterations therein be made until the plans and specifications showing the nature, kind, color, shape, height, materials, and location thereof shall have been first submitted to and approved by the Committee. It is violation of the Florida State law,traffic code, to park any motor vehicle which will block the sidewalk on any street. This law is enforceable by the Melbourne Police and violators are subject to a fine. Think of your neighbors who must walk out in the street with their children if the sidewalk is blocked.
The Preserve at Lake Washington, is a "No Soliciting" community. The signs are posted at both entrances. If any one comes to your door to solicit any, product or service, you have every right to ask them to leave your property and the community. If they refuse, call the police and they will enforce the law. We are covered for enforcement as long as the signs are posted.
It is the responsibility of each homeowner owning a pet to keep the animal under control. The animal is not to be roaming through The Preserve without owner supervision and must be leashed while outdoors on a walk. This is a Brevard County Law. Also please clean up if your dog deficates on another homeowners property. Owners should curb their dogs in the area between sidewalk and street. Violations of this law can be called into animal control 633-2024.
The Preserve has a neighborhood watch program in effect and any homeowner who sees a suspicious car or individual or activity in the community is advised to call 911 for an immediate emergency or 409-2200 for suspicious incidents and 259-1211 for non-emergency.

We still have homeowners that have not paid their HOA dues for 2009 and some are delinquent for 2 and 3 years. Liens have been filed on these properties and discussion will be held at the next board meetings to turn over these delinquent properties to a collection agency. Next time you talk to your neighbor ask them if they have paid their dues. Mention that they could have a lien on their property. They can check liens on the clerk of courts web site.
